Vision Crew Unlimited, LLC (herein "VCU") here by leases to lessee, and Lessee hereby leases and hires from VCU, all property and equipment (herein the "UNITS") described in the schedule. Said property and equipment is leased pursuant to the terms set forth below.
The lease period shall commence on the date set forth on the rental sheets. The lessee shall not alter the UNITS, without the express written consent VCU. On the expiration date or termination of this lease said UNITS shall be returned to VCU is as good condition as when received. All costs of transportation to and from VCU shall be paid be lessee. Lease may be terminated at any time by VCU if lessee defaults in payment. VCU has the right to repossess merchandise in case of default or bankruptcy. Should cancellation occur by lessee after order is pulled, at VCU's option, a minimum charge of 10% can be charged for UNITS pulled from stock. In addition, UNITS that have been approved by VCU to be returned for credit will be subject to a minimum 25% restocking charge. All rentals are based on one week unless otherwise specified. If more than one week, the cost and time period will be listed on the rental sheet. If the lessee retains the UNITS after such date, customer shall pay additional rent weekly in advance. All deposits received by VCU shall be held as security for the performance of the lessee's agreements and at the option of VCU may be applied to the payment of rent as it comes due, and/or to make repairs for damage to said UNITS, and/or replacement costs for any losses, and/or to cure any default of lessee without prejudice to or suspension of any other or remedy of VCU. The (security) deposit also may be held and used by VCU until all of lessee's obligations are fully performed and the property returned to VCU. The lessee is responsible for all rental fees for lost items up to the date VCU is notified of the loss and is able to bill the loss charge. The amount of any deposit in no way defines or limits the lessee's liability for costs or obligations to VCU. Replacement costs (valuation) are always charged in addition to rental. It is understood that lessee agrees to provide qualified personnel to handle or operate all UNITS, unless VCU is providing such personnel to lessee.
All rentals are on a C.O.D. basis. VCU is not liable for any damage caused by or with any UNITS leased from VCU and VCU is herewith released from any claim or liability arising out of such damage.
If VCU is required to institute legal action to enforce payment of any amounts due or to otherwise enforce any of it's rights, lessee agrees to pay collection costs, court costs and reasonable attorney's fees and any cost the VCU might incur to exercise it's rights.
INSURANCE REQUIREMENTS
VCU shall be covered as an additional insured and loss payee on customer's applicable insurance policy. Customer shall provide VCU with an insurance certificate listing VCU as "Additional insured and Loss payee". Customer will pay the cost of any deductible arising out of a claim related to the lease.
